The Supreme Court on Wednesday observed that engaging with the concerns of young protesters offers the most effective approach to preventing violence during demonstrations. The bench, led by Chief Justice Surya Kant along with Justices Joymalya Bagchi and V Mohana, advised authorities to respond cautiously to isolated acts of unrest in otherwise peaceful protests and agitations.

The remarks came while considering a petition that sought action against the Cockroach Janta Party for its alleged role in clashes, including stone-pelting, that occurred during recent marches in Delhi and other regions.

The Chief Justice noted that law enforcement should exercise restraint in a democracy and avoid actions that could escalate tensions. He emphasised that listening to the grievances of participants remains the strongest means of maintaining order.

The court indicated it would consider the central government’s position at a later date and left operational decisions to the relevant agencies. It added that preserving public order is important, yet responses must not aggravate the situation.

Counsel for the petitioner argued that protest organisers had incited disorder and should face consequences. He claimed the leaders were spreading unrest through media appearances and warned that further groups might join upcoming marches, potentially worsening conditions. The counsel also pointed out that the organisation lacked registration and official permission for the route.

The bench stated it remained open to all perspectives, including dissenting ones, while affirming that stone-pelting and similar acts must result in legal proceedings.
