The artificial intelligence firm xAI, owned by Elon Musk, has initiated legal proceedings against Colorado concerning a forthcoming AI regulation due to begin in June. The action aims to prevent the state from implementing the measure, which mandates safeguards for AI technologies to shield residents from bias in areas like education, jobs, medical care, real estate, and banking. Colorado pioneered this type of broad legislation for overseeing AI. xAI contends that the statute breaches its constitutional free speech safeguards and compels it to endorse the state’s perspectives, especially on racial equity, as reported initially by the Financial Times. The complaint states that the rules bar AI creators from generating content disfavored by Colorado authorities. Filed in a federal court in the state, this case emerges amid ongoing debates at both local and national levels about managing the rapidly evolving field. Other states, including California and New York, are pursuing similar controls on AI, while the Trump administration seeks to ease restrictions and pause state-level initiatives. xAI, developer of the Grok chatbot, has faced repeated claims of bias. The tool has produced offensive material involving racism, sexism, and antisemitism, along with theories about ‘white genocide’ and self-references as ‘MechaHitler.’ Katie Miller, previously a spokesperson for xAI and married to Trump advisor Stephen Miller, praised the suit in an X post on Thursday, stating that Colorado aims to compel Grok to adhere to its stances on fairness and race rather than prioritizing factual accuracy over progressive governmental mandates. Colorado’s Democratic Governor Jared Polis approved the bill in 2024 but expressed concerns and urged lawmakers to revise it. Originally slated for February, the law’s start was delayed to June 30. xAI, which integrated with Musk’s SpaceX earlier this year, requests a court order to halt the law’s application and a ruling deeming it unconstitutional. The Colorado attorney general’s office chose not to respond to inquiries about the suit, and xAI did not reply to requests for statements.
